Required for all drivers, passengers, and media on Powwow Raceway property.
I understand and acknowledge that participation in off-road motorsport events, including but not limited to driving, co-driving, passengering, spectating, and media coverage at Powwow Raceway, involves inherent risks of serious bodily injury, permanent disability, paralysis, property damage, and death. These risks include, but are not limited to: vehicle rollovers and collisions, high-speed impacts, debris, dust and reduced visibility, uneven terrain, mechanical failure, the actions of other participants, and emergency situations. I voluntarily and knowingly assume all such risks, both known and unknown, whether or not described herein.
In consideration of being permitted to enter and participate in any capacity at Powwow Raceway events, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby fully release, waive, discharge, and covenant not to sue Powwow Raceway LLC, the Cahuilla Band of Indians, the property owners, event organizers, promoters, officials, flaggers, safety personnel, medical personnel, volunteers, sponsors, advertisers, and their respective officers, directors, employees, and agents (collectively, the "Released Parties") from any and all claims, demands, losses, damages, costs, and causes of action arising out of or relating to my participation in or presence at any Powwow Raceway event, including claims arising from the negligence of the Released Parties.
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from my actions, conduct, or presence at any Powwow Raceway event, including claims made by third parties arising from my conduct.
I consent to receive emergency medical treatment in the event of injury or illness during my participation in or presence at any Powwow Raceway event. I acknowledge that Powwow Raceway LLC and the Released Parties are not responsible for the cost of any such medical treatment. I authorize event staff and emergency personnel to make medical decisions on my behalf if I am unable to do so.
I acknowledge that Powwow Raceway LLC and the Released Parties are not responsible for any damage to, theft of, or loss of my vehicle, equipment, or personal property while on Powwow Raceway property. I accept full responsibility for my vehicle and all property I bring onto the premises. I acknowledge that my vehicle will be subject to a safety inspection at check-in and that failure to meet safety requirements will result in denial of track access without refund.
I agree to read, understand, and comply with all rules set forth in the Powwow Raceway Driver & Media Rule Book, including all safety requirements, flag signals, speed limits, and instructions from event staff. I understand that failure to comply may result in immediate removal from the property without refund. I agree to conduct myself in a safe and respectful manner at all times and to not operate any vehicle or equipment while under the influence of alcohol or any substance.
I acknowledge that photography and videography may take place at Powwow Raceway events. I grant Powwow Raceway LLC the irrevocable right to use photographs, video, and audio recordings in which I appear for promotional, marketing, and social media purposes without compensation. I waive any right to inspect or approve such use.
If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect. This agreement shall be governed by the laws of the State of California. Any disputes arising hereunder shall be resolved in Riverside County, California. I acknowledge that I have had the opportunity to seek independent legal advice before signing this document.
